CBP issues guidance on additional duties for Indian imports

On August 25, 2025, US Customs and Border Protection published a Cargo Systems Messaging Service bulletin providing guidance on the application of additional ad valorem duties on goods imported from India.

The measures were imposed under the Executive Order titled “Addressing Threats to the United States by the Government of the Russian Federation.”

According to the guidance, the additional duties will apply to all Indian-origin products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. EDT on August 27, 2025.



The CSMS outlines specific instructions for entry filing, the correct sequencing of Harmonized Tariff Schedule codes, and clarifies which categories of goods will be exempt from the additional duties.

The bulletin further specifies that duty drawback will be available for these duties, allowing eligible exporters to claim refunds under established procedures.

For goods entering US foreign trade zones, products of India may only be admitted under “privileged foreign status”, which ensures they remain subject to the new duty rates when entered into US commerce.

Exceptions will apply only to items that qualify for admission under domestic status.

CBP’s publication provides importers, brokers, and other stakeholders with the operational details needed to comply with the new tariff requirements.
